The Panel considered a report of the Deputy Chief Executive and Director of Families and Communities regarding the proposed diversion of Public Bridleway No. 1 (Part) and No. 2 (Part) Bradley Parish under Section 119 of the Highways Act 1980. The Order was being promoted by the owner of the land crossed by the paths owing to the definitive routes being obstructed by farm sheds erected approximately 40 years ago. 

 

Public Bridleway Nos. 1 and 2 Bradley Parish formed part of an attractive off road route linking Bury Road, Bradley with Dales Lane, Haughton.

 

The effect of the Order was to divert the bridleways along a wide farm track to the south west of the Farm.

 

Members noted that the proposals had been subject to informal consultation and advertisement on site and that no objections were received. The Open Spaces Society, Peak and Northern Footpaths Society and British Horse Society all welcomed the proposals as a sensible solution to a long standing problem.

 

The cost of the making the Order was to be met by the applicant.     

 

RESOLVED – (a) That the report be received and noted.

 

(b) That the Deputy Chief Executive and Director for Families and Communities be authorised to make an Order under Section 119 of the Highways Act 1980 to divert sections of Public Bridleways Nos. 1 and 2 Bradley Parish, as set out in the report.

 

(c) That provisions be included in the Order such that it is also made under Section 53A of the Wildlife and Countryside Act 1981, to amend the Definitive Map and Statement of Public Rights of Way in consequence of the coming into operation of the diversion of part of Public Bridleway No. 1 and 2 Bradley Parish.

The Panel considered a report of the Deputy Chief Executive and Director of Families and Communities regarding the proposed diversion of Public Footpath No. 4 Ranton Parish. The proposed Order was being promoted by a landowner whose residential property (‘the Wicket’) lay in close proximity to the path causing privacy and security concerns.    

 

The effect of the Order was to divert the path across flat grassy fields to the south of its present location and to reconnect with its easterly section adjacent to a pond. The proposed new route offered a more scenic walk away from the grounds of The Wicket.

 

Members noted that the proposals had been the subject of informal consultation and advertisement on site and that no objections had been received. The Ramblers’ Association, Peak and Northern Footpath Society and Open Spaces Society had all welcomed the proposal and requested that gates be used instead of stiles, if required.     

 

The Deputy Chief Executive and Director of Families and Communities highlighted that the cost of the Order (approximately £2,500) was to be met by the applicant.  

 

RESOLVED – (a) That the report be received and noted.

 

(b) That the Deputy Chief Executive and Director of Families and Communities be authorised to make an Order under Section 119 of the Highways Act 1980 to divert part of Public Footpath No. 4 Ranton Parish, as set out in the report.

 

(c) That provisions be included in the Order such that they are also made under Section 53A of the Wildlife and Countryside Act 1981 to amend the Definitive Map and Statement of Public Rights of Way in consequence of the coming into operation of the diversion of part of Public Footpath No. 4 Ranton Parish. 

 

25.

HS2 Rail Link - Update

This item was included on the Agenda as a standing item. However, no report was available on this occasion.

 

The Chairman commented that he understood the Planning considerations for all applications associated with the project together with the consultees and timetable for determination of those applications had recently been published.  

 

The Director of Strategy Governance and Change undertook to Liaise with the County Council’s HS2 Project Manager regarding the date of their next meeting with a view to providing an update to them on progress with regard to HS2, as required. 

 

RESOLVED – That the Panel be provided with an update with regard to HS2 at their next meeting, as required.
