Friary School, Lichfield - Academy conversion and joint use agreement (exemption paragraph 3)

Minutes:

The Sub-Committee considered proposals to terminate a Joint User Agreement for The Friary, Lichfield which comprised a school site incorporating leisure facilities which were separately managed on behalf of Lichfield District Council for use by the community.

 

The School was reported to be converting to Academy status, necessitating the transfer of the lease of the school areas to the Multi-Academy Trust. 

 

The Sub-Committee considered the proposed arrangements for the continued use of the remainder of the site (Retained Parts) for leisure purposes and received details of on- going negotiations with Lichfield District Council on the Heads of Terms for the required Lease and Commercial Transfer Agreement.

 

RESOLVED -  That approval be given to the termination of the current Joint User Agreement to facilitate:

 

a)    The completion of a 125 year lease of part of the site, (excluding the ‘Retained Parts’) together with the associated Commercial Transfer Agreement; the lease to be at a peppercorn rental, and

 

b)    The grant of a Lease of the ‘Retained Parts’ to Lichfield District Council; the Heads of Terms for the Lease to be those proposed by the County Council with the permitted use extended to cover civil contingency need.  Officers to agree a schedule of condition and works to be undertaken by Lichfield District Council (if any) during the term of the Lease in respect of the repairing obligations for the interior and exterior of the Retained Parts demised by the Lease.

Holding No. 4 Whitemere Estate, Woodside Farm, Wood Lane, Yoxall, Burton upon Trent (exemption paragraph 3)

Minutes:

The Sub-Committee considered proposals to enter into a Commercial Letting Agreement with Miscanthus Bedding Limited for parts of Holding No. 4 Whitemere Estate, Woodside Farm, Yoxall.

 

RESOLVED – That approval be given to the commercial letting of the house, buildings and paddock on the Terms indicated in the report.
